Terms of Service

Draft, not legally reviewed. These terms are adapted from a published, openly licensed template and edited to describe what Catnap actually is and does. No lawyer has reviewed them, and none is expected to. Where a finished agreement would need a decision Catnap has not made, this page says so rather than filling in a guess. Do not treat this as a finished legal document.

Who these terms are between

Thank you for using Catnap. Catnap is a small, free service, and these terms exist so that both of us know what we have agreed to.

"We", "our", "us" - Nebuloom, LLC, which operates Catnap.
"The Service" - the Catnap application at catnap.work, this website, and anything else Catnap offers.
"You", "your" - the person signed in to Catnap with a Google account. A Catnap account belongs to one person: there are no organization accounts, no seats, and no way to add another person to yours.

We may update these terms in future. When we make a significant change we will refresh the date above and take any other step that seems appropriate to tell you. When you use the Service, now or in future, you are agreeing to the latest terms. There may be times when we do not exercise or enforce a right or provision of these terms; that does not mean we are waiving it.

These terms contain a limitation of our liability.

Your account

Catnap has no password of its own. You sign in with Google, so the security of your Catnap account is the security of the Google account you sign in with. Keeping that account secure is yours to do, and we cannot be liable for any loss or damage arising from a failure to.
You must be a human, and at least 13 years old. Accounts registered by bots or other automated methods are not permitted. Catnap is not intended for children under 13, and we do not knowingly create accounts for them.
Do not use Catnap against anyone else. Do not attempt to reach another person's account or data, to disrupt the Service for other people, or to defeat a limit or safeguard in it. Reporting a security problem you have found in good faith is welcome and is not a breach of this.

Catnap is free

Catnap is free, and it is really free: we do not ask you for a credit card, there are no paid plans or trials, and we do not sell your data. Nothing here obliges you to pay us anything, and nothing obliges us to keep offering the Service - see "Changing or ending the Service" below.

Your Google Calendar authorization

Catnap works by reading your Google Calendar with your permission. Three things follow from that, and they are part of this agreement:

Read-only, and narrow. Catnap asks Google for read-only access to your calendar list, your events, and your calendar time zone setting, and for nothing else. It never asks for write access, and never creates, edits, or deletes anything in your Google Calendar.
You can revoke it at any time. From Catnap's Settings page, or from your Google Account directly. Revoking stops Catnap reading your calendar; it does not by itself delete what Catnap has already imported - see "Deleting your data and closing your account" below.
Google's own terms apply too. Your use of Google Calendar is between you and Google. If Google changes, limits, or withdraws the access Catnap depends on, the Service may stop working in whole or in part, and we cannot promise that it won't.

What Catnap does with the calendar data it reads is described in the privacy policy, including the one step that sends a minimized part of an event to a third-party AI provider, and the switch that turns that step off.

What Catnap's reports are, and are not

Catnap reports what your calendar said was scheduled, and it guesses which of that scheduled time is work and who or what it relates to. Those are inferences drawn from calendar evidence, not observations of what you actually did, and every one of them is yours to correct.

So Catnap is not a time tracker, not a payroll, invoicing, or billing system, and not a record of hours worked. Do not rely on its output as evidence of time worked - to an employer, a client, a tax authority, a court, or anyone else - without checking it yourself. We make no warranty that any classification, entity, or total it produces is accurate.

Deleting your data and closing your account

You can leave at any time, and Settings offers three separate actions, each doing exactly what it says: disconnect Google, delete all imported data, or delete your account. The privacy policy describes what each one covers.

Deleting your account revokes Catnap's access to your Google account and removes the account itself, along with everything Catnap imported or derived for you, from the running Service. We keep encrypted database backups for disaster recovery. Each deletion is recorded outside those backups, so that if one is ever restored the deletion can be applied again rather than silently undone. Once your data is deleted we cannot recover it for you.

Suspension and termination

We may suspend or end your access to the Service at any time and for any reason. Suspension means you cannot reach your account or anything in it; termination means the account and its contents are deleted. We may also refuse the Service to anyone. That is a broad statement, and it means using Catnap asks you to place trust in us.

Abuse of, or threats against, whoever runs Catnap will end your account immediately.

We may also temporarily disable an account whose usage is far beyond ordinary use of the Service. Catnap runs on one small server, so one account's runaway usage degrades it for everybody. We will try to reach you first, except where the load is actively harming the Service.

Changing or ending the Service

Sometimes it becomes technically impossible to continue a feature, or we redesign part of the Service because we think it could be better. We reserve the right, at any time, to modify or discontinue any part of the Service, temporarily or permanently, with or without notice. Catnap is a small project: there is no service-level agreement, and no promise about how long it will exist.

Availability, security, and privacy

Your use of the Service is at your sole risk. We provide it on an "as is" and "as available" basis. There is no uptime commitment and no status page.

We take measures to protect your data - encryption in transit, encryption of your Google authorization at rest, and backups - and the privacy policy describes what Catnap stores and who else sees it. You agree that we may process your data as the privacy policy describes, and for no other purpose.

Whoever runs Catnap can technically reach the database your data is stored in. That access is used only:

to answer a support request you have made, with your consent;
to diagnose a failure that Catnap's own logs and metrics cannot explain, looking at the least data needed to fix it;
to keep the Service and the people using it secure; and
to the extent required by applicable law.

The Service runs on servers and a database hosted by Amazon Web Services in the United States. That is infrastructure Catnap runs on, rather than another party Catnap hands your calendar to; the privacy policy is where the parties Catnap actually sends calendar content to are described.

Ownership

Your calendar data stays yours. You grant us only what the Service needs in order to read your calendar and show you the result: the read-only Google authorization above, and permission to process what it returns as the privacy policy describes. We claim no ownership of it.
Catnap stays ours. We or our licensors own all right, title, and interest in the Service, including every intellectual property right in it, and you obtain no ownership rights in it by using it. You may not duplicate, copy, or reuse any portion of its HTML, CSS, JavaScript, or visual design without our permission, and you may not resell or otherwise exploit the Service or access to it.

Features and bugs

We design the Service with care, but there is no such thing as a service that pleases everybody. We make no guarantee that it will meet your particular requirements or expectations.

We test features before shipping them. As with any software, the Service inevitably has some bugs. We work through the ones reported to us, prioritizing anything touching security or privacy. Not all reported bugs will get fixed, and we do not guarantee an error-free Service.

Liability

You expressly understand and agree that we shall not be liable, in law or in equity, to you or to any third party for any direct, indirect, incidental, lost profits, special, consequential, punitive or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data or other intangible losses (even if we have been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the Service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the Service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the Service; or (v) any other matter relating to these terms or the Service, whether as a breach of contract, tort (including negligence, whether active or passive), or any other theory of liability.

In other words: choosing to use Catnap means making a bet on us. If the bet does not work out, that is on you, not us.

Governing law

These terms are governed by the laws of the State of Washington, United States, without regard to its conflict of law rules. Any dispute arising out of them will be heard in the state or federal courts located in King County, Washington.
